Terms of Service
Last updated: October 19, 2026
These terms are an agreement between you and Next Genesis LLC ("Next Genesis", "we", "us"), a Colorado company based in Colorado Springs, about your use of Review Leaderboard (the "App").
"You" means the business or agency that installs or pays for the App. The App is for businesses only; it is not sold to people for personal or household use. By installing the App, or using it after these terms are shown to you, you accept them. If you install it for someone else (for example, an agency installing it on a client's sub-account), you confirm you have the authority to accept these terms for that client.
1. What the App does
Review Leaderboard gives each member of your team a personal link, QR code and NFC link that sends customers to your business's review page (for example on Google or Facebook). It records when a link is opened ("a scan") and shows those scans on a leaderboard and on each team member's card.
A scan is not a review. A scan means a link was opened. The App does not know whether a review was written, what it said, or who wrote it. Scan counts are approximate: to stop abuse, the App counts one scan per phone per badge per day, ignores link previews and bots, and caps scans from one network. So one customer can be counted twice (two phones), and real scans can go uncounted (shared Wi-Fi, caps).
2. Your account and access
- The App runs inside your CRM account through the CRM's app marketplace. Access follows your CRM user roles: account admins can change settings; other users can view.
- Manager phone links let anyone who has the link rename and reset badges from a phone. Team member card links show one person's card. Neither needs a password, so keep them private. Making a new manager link turns off the old one, and uninstalling turns off all manager links.
- You're responsible for what your users do in the App and for keeping your CRM logins and these links secure.
3. Pricing, trial, billing and cancellation
- The App costs $29 per month for each sub-account it's installed on. If the marketplace listing shows a free trial (currently 7 days), the paid subscription starts when the trial ends unless you uninstall first. Who qualifies for a trial is set by the marketplace.
- Billing is handled by the CRM's app marketplace, not by us. The marketplace shows the price before you install, charges you, retries failed payments and may add taxes where required. Its billing terms also apply. If you are an agency, the $29 is what you pay; what you charge your own clients is up to you.
- The subscription renews every month until you cancel.
- You can cancel at any time through the marketplace, including by uninstalling the App. You won't be charged for later months. Uninstalling ends the App right away (see section 11), so if you want to use the rest of a paid month, uninstall near its end.
- Payments are non-refundable, except where the marketplace's own refund policy or the law gives you a refund.
- We may change the price with at least 30 days' notice, given in the App or by email to the address the marketplace gives us. The new price starts with your first billing month after the notice period. If you don't accept it, cancel before then.
- If the marketplace tells us a payment failed or your subscription ended, we may pause the App until it is sorted out.
4. Review-site rules and consumer-review laws
Asking for reviews is regulated. Google, Facebook and other review sites have their own rules, and in the US the FTC's rule on consumer reviews (16 CFR Part 465) and state consumer protection laws (including Colorado's) apply to your business. You agree to follow them. In particular, you and your team must not:
- offer anything for a review: no payment, discount, gift, entry into a prize draw or other reward to customers for leaving, changing or removing a review;
- gate reviews: ask only happy customers, screen customers before showing them the link, or discourage negative reviews;
- set review quotas or targets for staff, or run contests or prizes tied to reviews. We recommend you don't tie pay, bonuses or prizes to scan counts either, since a review site may treat that the same way;
- ask customers to mention a staff member or to include any particular content in their review;
- pressure customers, for example by insisting or standing over them while they write a review on site;
- write or arrange reviews from insiders: owners, managers, employees, agents and their relatives must not review your business (Google doesn't allow it at all, and the FTC rule requires a clear disclosure at minimum). Tell your team this, and don't ask them to get reviews from their own family or friends;
- post fake reviews or buy, sell or swap reviews.
The App is built to fit these rules: it counts asks, not reviews, sends every customer straight to the review page with no "are you happy?" screen, and has no targets or prizes. But you are responsible for how your business uses it, including any pay or incentive plan you set for your team. We don't promise any number of reviews, any rating, or any search ranking, and review sites decide on their own which reviews to show or remove.
5. Your data
- You own your data: your business details, team member names, settings and scan records.
- You let us store and process it only to provide, secure and support the App and to fix and improve it, as described in section 6 and our Privacy Policy. We don't sell it or use it for advertising.
- You can see your data in the App at any time. For an export, an admin can email us at matt@nextgenesissites.com and we'll confirm the request comes from your account before sending it.
- Use first names or initials for team members. Don't put sensitive personal information (health, financial, ID numbers) in names or settings.
- Tell your team members that the App shows their name and scan counts to your account's users and on their own card.
- Don't rely on scan counts alone for pay or discipline decisions. They are an approximate count of links opened (section 1), not a measure of work or of reviews.
6. Data processing terms
For personal information about your team and your customers' scans, you are the controller (you decide why and how it's used) and we are your processor (also called a service provider). This section is our data processing agreement with you.
- What we process: team member display names, scan records (time, badge, and two coded values made from the scanning phone's internet address and browser type, never the address itself), change logs, and the CRM user ID and role of signed-in users. People involved: your team members, your CRM users, and customers who scan a badge.
- Why and how long: only to run the App for you, for as long as it is installed plus the 30 days in section 11, then we delete it.
- Our commitments: we process this data only on your instructions (using and configuring the App counts as your instructions), unless a law requires otherwise, and we'll tell you if we think an instruction breaks the law. We don't sell or share it, use it for advertising, use it for any purpose outside providing the App, or combine it with data from other customers or sources, except as the law allows a processor to. Anyone we allow to access it is bound to keep it confidential. We keep reasonable security in place (see the Privacy Policy) and will tell you if we can no longer meet these commitments; you may then stop our use of the data by uninstalling.
- Subprocessors: we use the subprocessors listed in the Privacy Policy, under written terms that protect the data at least as well as this section. We'll update that list at least 30 days before adding a new subprocessor that handles your personal data; if you object, you can cancel.
- Helping you: we'll help you answer requests from people about their data and meet your legal duties, as far as the App's data allows. Scan records can't usually be linked to a named person.
- Security incidents: if we confirm a breach affecting your data, we'll tell you without undue delay, with what we know and what we're doing about it.
- Checks: we'll answer reasonable written questions about how we protect your data. If a privacy law that applies to you requires an audit or assessment, we'll cooperate with a reasonable one, at your cost, no more than once a year.
- Location: the App is offered to businesses in the United States and the data is processed in the US and on Cloudflare's global network. We don't offer EU or UK transfer terms.
7. Acceptable use
You won't: use the App to break the law or any review site's rules (section 4); scan, script or otherwise fake scans to inflate counts; try to reach another account's data; probe, overload or attack the App; resell or sublicense the App except through the marketplace's resale feature; or copy, decompile, reverse engineer or build a competing product from the App.
8. Agencies
If you install the App on clients' sub-accounts, you are our customer for those installs. You agree to make sure your clients follow sections 4, 5 and 7, to give them these terms or terms at least as protective of us, and to handle their billing and first-line support. Your clients' data is still covered by section 6.
9. Our software and ownership
The App is licensed to you, not sold. Next Genesis keeps all rights in the App, its code, design and name. Your subscription gives you a limited, non-exclusive, non-transferable right to use the App while you pay for it. If you send us ideas or feedback, we may use them without owing you anything. For licensing, white-label or acquisition enquiries, email matt@nextgenesissites.com.
10. Availability and changes
We work to keep the App running but don't promise it will be uninterrupted or error-free. Badge links are built so customers still reach your review page even when counting is paused. We may improve or change features; if we remove a core feature, we'll tell you first. We may suspend an account that breaks section 4 or 7 or puts the service at risk, and we'll tell you why unless the law or a security risk prevents it.
11. Uninstalling, ending the agreement and deletion
- You can end this agreement at any time by uninstalling the App. We can end it with 30 days' notice, or right away if you seriously break these terms.
- When the App is uninstalled: it stops counting scans at once, the leaderboard and manager links close, and badge links keep sending customers to your review page. Your data is kept for 30 days so a reinstall restores everything.
- After 30 days we delete your data, and from then on your badge links (including printed QR codes and NFC tags) stop working. Deleted data can stay in our hosting provider's database restore history for up to 30 more days before it is gone for good.
- Sections 4 (your responsibility for past use), 5, 6 (until deletion), 9, 12, 13, 14 and 15 continue after the agreement ends.
12. Disclaimers
The App is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties not stated in these terms, including merchantability, fitness for a particular purpose and non-infringement. The CRM platform, the marketplace and review sites are run by others; we're not responsible for their changes, outages or decisions (for example, removing reviews, suspending a listing, or changing their policies).
13. Limitation of liability
To the extent the law allows:
- Neither side is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, reviews or business, even if told they were possible.
- Our total liability for all claims about the App is limited to $100.
- These limits don't apply to your payment obligations, your obligations under section 14, or either side's fraud or willful misconduct.
14. Your responsibility for claims
You'll defend and pay for any claim, fine or penalty brought against us by a third party or a regulator because of how you or your team used the App, including a breach of section 4 or 7, the content you put in the App, or your dealings with your team, customers or clients. We'll tell you promptly about the claim, let you control the defense (you can't settle it in a way that admits fault for us without our consent), and give reasonable help at your cost.
15. General
- Law and courts: these terms are governed by Colorado law, without regard to its conflict-of-law rules. Any dispute goes to the state courts in El Paso County, Colorado, or the federal court for the District of Colorado, and both sides agree to those courts' jurisdiction. Before filing, each side will first try to settle the dispute by email for 30 days.
- Changes to these terms: we may update these terms. We'll post the new version with its date and, for material changes, give at least 30 days' notice in the App or by email. If you keep using the App after a change takes effect, the new terms apply; if you don't agree, cancel before then.
- Notices: we send notices in the App or to the email address the marketplace gives us. You send notices to matt@nextgenesissites.com or by mail to Next Genesis LLC, 3009 Grandview St, Colorado Springs, CO 80907.
- Assignment: you may not transfer this agreement except through the marketplace's own transfer process. We may transfer it as part of a merger, acquisition or sale of the App, and we'll tell you if we do.
- Events outside our control: neither side is responsible for delays caused by events it can't reasonably control, such as outages at our hosting provider, the CRM or a review site.
- Whole agreement: these terms and the Privacy Policy are the whole agreement about the App. If part of these terms can't be enforced, the rest still applies. Not enforcing a term isn't a waiver. We're independent businesses; nothing here makes us partners or employees of each other.
